Surface Pattern Design: Grow Your Career With an E-commerce Business (Dropshipping Course)

1. Overview
This Course is owned and operated by Erin Kendal (“we”, “our”, or “us”).
Please read these Terms and Conditions (“Terms”) carefully before you purchase or otherwise access our online course, Surface Pattern Design: Grow Your Career With an E-commerce Business (“Course”). These Terms, along with our Site Terms and Conditions, our Privacy Policy, and the Terms and Conditions of our third-party payment processor (Stripe), govern your access to and participation in the Course.
By purchasing or accessing the Course, you:

confirm that you are over 18 years of age and have the legal capacity to enter into a binding contract;

acknowledge that you have read, understood, and agree to comply with these Terms; and
-
acknowledge that you have read, understood, and agree to comply with the Terms of Stripe (https://stripe.com/ ).
We reserve the right to update these Terms at any time. Changes will take effect from the date they are posted on our Site. By continuing to access the Course, you accept any future amendments to these Terms.
2. Course Access

Access begins once you have paid the Course Fee.

Access continues until terminated under these Terms or until the Course is discontinued. If we discontinue the Course, we will provide at least seven (7) days’ notice.

You must provide accurate and complete information when enrolling. We may suspend or terminate your access if we suspect your information is false or incomplete.

Account details (including passwords) must be kept secure. You are responsible for all activity under your account.
3. Course Fee

The Course Fee must be paid in full upfront.

All payments are processed securely by Stripe. By purchasing, you also agree to Stripe’s Terms and Conditions.
4. Refunds and Cancellations

Due to the digital nature of the Course, all sales are final.

Refunds are only provided as required by law or at our sole discretion.
5. Intellectual Property & Permitted Use
All materials provided in the Course (including videos, templates, downloads, workbooks, and other content, collectively “Materials”) are owned by or licensed to us.
You are granted a non-exclusive, non-transferable, single-user license to access and use the Materials for your own personal business and design purposes only.
You may not:

share, copy, distribute, resell, sublicense, or otherwise allow others to access the Materials;

modify, adapt, or create derivative works for the purpose of resale, teaching, or distribution;
-
assign or transfer your access to another person.
Any unauthorised use may result in termination of access without refund and legal action.
5A. No Teaching, Training, or Repurposing
You may not use the Course or any part of the Materials to teach, train, coach, or otherwise instruct others in dropshipping, e-commerce, or surface pattern design, whether paid or free.
This includes (but is not limited to):
-
creating your own courses, workshops, memberships, or training programs based on the Course or its methods;
-
publishing guides, ebooks, or resources that reproduce or adapt the content of the Course;
-
offering consulting or coaching services that replicate or rely on the strategies taught in the Course.
Any breach of this clause will result in immediate termination of access without refund and may lead to legal action to protect our intellectual property rights.
5B. Artificial Intelligence and Machine Learning Restrictions
You must not upload, transmit, or otherwise make available the Course, the Materials, or any part thereof to any Artificial Intelligence (“AI”) or machine learning system. Without limitation, you are expressly prohibited from using the Course or the Materials as prompts, training data, inputs, or source files for any AI or machine learning model, tool, or application. You must not generate derivative works through AI or machine learning processes for the purposes of resale, redistribution, publication, or commercial licensing.
Any breach of this clause will result in immediate termination of your license without refund and may give rise to legal action to protect our intellectual property rights.
6. Confidentiality
You agree not to share any confidential information about our business, strategies, or other participants that you may encounter during the Course.
6A. Platform Dependency & Limitations
This Course is designed to show you how to build a dropshipping model using Spoonflower as the production and fulfillment provider. You acknowledge and agree that:

Spoonflower does not formally offer a dropshipping service; instead, the method taught in this Course relies on Spoonflower’s existing features, including their PLUS membership, to make dropshipping possible.

Because Spoonflower is a third-party platform outside our control, we cannot guarantee that the features, services, or terms enabling dropshipping will remain available.

If Spoonflower changes or discontinues its services, features, pricing, or terms in a way that affects dropshipping, we are not liable for any resulting impact on your business.

No refunds will be issued in such circumstances, as this risk is inherent to using third-party platforms.
6B. Promotional Use of Content
By participating in the Course, you may choose to share feedback, testimonials, results, or other content (“Student Content”) with us, whether by email, survey, social media, or within any associated group.
You grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display your Student Content — including your name, business name, and likeness if provided — for promotional purposes in our marketing, sales materials, and online platforms.
We will never disclose sensitive personal information (such as financial or health details) without your explicit consent.
7. Prohibited Use
You may not use the Course or Materials:

for unlawful purposes;

to compete with our business;
-
to infringe on intellectual property rights;
-
to attempt to interfere with or disrupt the Course; or
-
to send spam or unauthorised promotional material.
8. Warranties and Indemnities
The Course is provided on an “as is” basis. We do not guarantee specific outcomes. Results will vary based on your effort, skills, and market conditions.
You agree to indemnify us against any loss, damage, or claims arising from your breach of these Terms.
9. Earnings Disclaimer
We make no promises regarding income, sales, or specific results from participating in the Course. Examples of past participant outcomes are illustrative only and not a guarantee of future performance.
10. Affiliate Disclosure
From time to time, we may work with affiliates who promote our Course. They may receive a commission for referrals. This does not affect the price you pay.
11. Termination
We may immediately terminate your access to the Course if you:

infringe our intellectual property rights;

act in a way that damages or risks our reputation;
-
disclose confidential information without consent; or
-
otherwise breach these Terms.
If termination occurs, refunds will not be provided except at our sole discretion.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts in that state.
