PSA Trend Spotlight 'Public Version' – Terms & Conditions

1. Overview

This product is owned and operated by Erin Kendal (“we”, “our”, or “us”).
By purchasing the PSA Trend Spotlight (“Product”) you:

  • Confirm that you are over 18 years of age and have the legal capacity to enter into a binding agreement.

  • Acknowledge that you have read, understood, and agree to comply with these Terms & Conditions (“Terms”).

We reserve the right to update these Terms at any time. Any changes will apply to purchases made after the revised Terms are posted.

2. Nature of the Product

The PSA Trend Spotlight is a digital download delivered electronically.

  • No physical goods will be shipped.

  • Access is granted immediately after purchase via the email address you provide at checkout.

  • It is your responsibility to ensure you have provided accurate contact details and that your device/software can open the file formats provided.

3. Payment & Refund Policy

  • All prices are listed in USD unless otherwise stated.

  • Payment is processed securely via a third-party payment provider (Stripe), and by purchasing you also agree to their terms.

  • Due to the digital nature of this product, all sales are final. We do not offer refunds, exchanges, or credits after purchase except as required by law.

4. License & Permitted Use

Upon purchase, you are granted a non-exclusive, non-transferable, single-user license to access and use the Product for your own personal and commercial design creation purposes.
You may not:

  • Share, resell, sublicense, or redistribute the Product or any part of it.

  • Upload the Product or its contents to any public or private database, group, or file-sharing system.

  • Modify, adapt, or create derivative works for the purpose of resale, teaching, or distribution.

5. Intellectual Property Rights

All materials in the PSA Trend Spotlight — including text, graphics, images, layouts, and curated content — are protected by copyright and other intellectual property laws.
We retain all rights, title, and interest in the Product and its content.
Any unauthorized use may result in termination of your license and legal action.

6. No Guarantees & Disclaimer

The Product is designed to provide information and inspiration to help you create market-aligned designs.
We make no guarantees of sales, income, or specific outcomes from using this Product.
Examples or references to past success are not promises of future results.
You are solely responsible for how you use the information provided.

7. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any loss, damage, or expenses arising from your use of, or inability to use, the Product — including but not limited to loss of profits, business interruption, or indirect damages.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia.
You agree to submit to the exclusive jurisdiction of the courts in that location.
